The Future of the Affordable Care Act (ACA) – Ongoing Developments in the Constitutionality Challenge

The previous article in this series describes the ongoing challenge to the ACA’s individual mandate. While the Supreme Court took a pass on hearing the case early, this week, they made the decision to hear the case this fall.

The Supreme Court’s session runs from October to June, with many decisions coming near the end of the session.

Therefore, while the Supreme Court will begin hearing oral arguments in October, it is highly unlikely that there will be any kind of decision prior to the November 3, presidential election. It is more likely that a decision is likely to come in the spring of 2020.

In the interim, the ACA remains the law of the land and employers should continue to comply with all its provisions. As always, we will continue to bring updates as they arise.
